These Terms & Conditions ("Terms") govern your use of the Caribbean Watersports & Enviro-Tours ("Caribbean Watersports," "we," "us," or "our") website and your booking and participation in our private charters, tours, and related services. By using our website or booking a trip, you agree to these Terms.

This document is a working draft prepared for review by our legal counsel before publication. It is not legal advice and the final language — including cancellation windows, deposit amounts, and liability terms — is subject to that review and to the actual waiver guests sign.
1. About these Terms
These Terms apply to everyone who visits our website or books or joins a trip. If you book on behalf of others in your party, you confirm that you have the authority to accept these Terms for everyone in your group, and you are responsible for making sure they understand and follow them. If you do not agree with these Terms, please do not use our website or book a trip.
2. Bookings and reservations
- All trips are private and operate by reservation only. A booking is not confirmed until we acknowledge it and any required deposit is received.
- We do our best to honor your requested date, time, party size, and bayside pickup location (between approximately MM92 and MM103), but availability is not guaranteed until confirmed.
- You agree to provide accurate, complete booking information, including the number of guests and any relevant health, mobility, or accessibility needs.
- We reserve the right to decline or cancel any booking at our discretion, including for safety reasons or capacity limits.
3. Pricing, payments, and deposits
- Prices are quoted at the time of booking and may change for new bookings. The price confirmed for your reservation is the price that applies to your trip.
- For instant-book reservations, a 50% deposit is due at the time of booking to confirm your date and time; the remaining balance is due on or before the day of your trip. Reservations made within 3 days of the trip date are paid in full at the time of booking. For by-request experiences, our crew will confirm pricing and any deposit before your reservation is finalized.
- Quoted totals include applicable Florida sales tax, processing fees, and an automatic 18% crew gratuity. Additional gratuity is always welcome but never required.
- Payments are processed by a third-party payment processor; by paying, you also agree to that processor's terms.
4. Cancellations, changes, and refunds
- By you: Cancellations or reschedules made at least 48 hours before your scheduled departure receive a full refund of your deposit or a no-fee reschedule. Within 48 hours of departure, deposits are non-refundable but may be applied to a future date when scheduling allows. No-shows are charged in full.
- Late arrivals / no-shows: Trips run on a schedule. If you arrive late, your trip time may be shortened, and no-shows may be charged in full.
- By us (weather & safety): Your safety comes first. We may cancel, delay, shorten, reroute, or reschedule a trip due to weather, sea conditions, mechanical issues, or other circumstances beyond our control. In those cases we will offer to reschedule or, where appropriate, provide a refund or credit for the affected portion. We are not responsible for travel, lodging, or other costs you incur.
5. Your responsibilities and conduct
- Follow all instructions from the captain and crew at all times. The captain has full authority over the vessel and may take any action necessary for safety.
- Arrive on time and at the agreed pickup location, ready for water activities as applicable.
- Wear provided safety equipment, including life jackets, when instructed.
- Behave responsibly. We may refuse service to, or end a trip for, anyone who is intoxicated, disruptive, unsafe, or who endangers themselves, other guests, the crew, or marine life — without refund.
- Respect the marine environment. Do not touch, stand on, remove, or damage coral, seagrass, wildlife, or protected areas, and comply with all sanctuary and wildlife rules.
6. Health, swimming ability, and accessibility
Boating and water activities require a reasonable level of health and mobility. You must tell us in advance about any medical condition, injury, pregnancy, swimming limitation, or accessibility need that could affect participation or safety. We are glad to make reasonable accommodations where we safely can — see our Accessibility Statement — but boats and natural pickup locations have physical limitations, and participation is at your own discretion and risk.
7. Assumption of risk and liability waiver
Watersports and boating activities involve inherent risks, including but not limited to weather and sea conditions, slips and falls, sun and heat exposure, marine life, equipment use, and the risks of swimming and snorkeling. By participating, you voluntarily assume these risks for yourself and your party.
All guests (or a parent/guardian for minors) may be required to read and sign a separate liability waiver and release before the trip. That signed waiver, together with these Terms, governs your participation. To the fullest extent permitted by law, you agree to release and hold harmless Caribbean Watersports & Enviro-Tours, its owners, crew, and agents from claims arising out of participation, except to the extent caused by our gross negligence or willful misconduct.
8. Photography
We may take photos or video during trips for our records and promotion. If you prefer not to be photographed or featured, let your crew know and we will respect that.
9. Website use and intellectual property
- The content on this website — including text, photos, logos, and design — is owned by or licensed to Caribbean Watersports and is protected by applicable laws. You may not copy, reproduce, or use it without our permission, except for normal personal, non-commercial viewing.
- You agree not to misuse the website, interfere with its operation, or use it for unlawful purposes.
- The website is provided "as is." We do our best to keep information accurate and current, but we do not warrant that it is error-free or always available.
10. Third-party services and links
Our website may use or link to third-party services (such as payment processing, maps, reviews, video, and chat). We are not responsible for the content or practices of those third parties, and their own terms and policies apply to your use of them.
11. Limitation of liability
To the fullest extent permitted by law, Caribbean Watersports and its owners, crew, and agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of our website or services. Where liability cannot be excluded, it is limited to the amount you paid for the affected trip. [Subject to counsel review and applicable law.]
12. Indemnification
You agree to indemnify and hold harmless Caribbean Watersports from claims, losses, and expenses arising out of your breach of these Terms or your (or your party's) negligent or wrongful conduct during a trip.
13. Governing law
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be handled in the appropriate courts located in Monroe County, Florida, unless otherwise required by law. [Venue and any dispute-resolution provisions subject to counsel review.]
14. Changes to these Terms
We may update these Terms from time to time. Changes take effect when posted, and we will update the "Last updated" date above. The Terms in effect when you book apply to that booking. Your continued use of our website or services after an update means you accept the revised Terms.
